President Obama was asked about
his administration's intervention in the Proposition 8 case of Hollingsworth v Perry and gave
a very cogent reply which is caught on video. Word comes that the government has decided that it also wants to argue it's position before the Court, even though is it is not a party to the suit. Solicitor General
Donald Verrilli filed a motion with the court to have some time to argue the position of the United States that Proposition 8 be overturned because denying same-sex couples the name "marriage" while giving them all the legal incidents of marriage is unconstitutional.
If the Court were to agree with this argument, then it is likely that the marriage laws of 8 states: California, Delaware, Hawaii, Illinois, Nevada, New Jersey, Oregon, and Rhode Island. This is becoming known as the 8-state solution after a famous lecture given by
Kenji Yoshino almost a year ago.
The Court
has other options in making its decision in Perry, however. It is likely that they will gant the Obama's administration to have some time at oral argument.
