There are 23 states where you can be fired for being transgender, gay or lesbian without any legal recourse under state law. If Congress were to pass the Employment Non-Discrimination Act, that would produce a federal law that would prohibit anti-LGBT employment discrimination. The Equal Employment Opportunity Commission has ruled that transgender employment discrimination is illegal due to Title IX of the 1964 Civil Rights Act inclusion of "sex" as a category.
